Acceptance of Terms
By accessing or using Socialdive at socialdive.ai, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must discontinue use of the platform immediately.
Description of Service
Socialdive is a tool designed to help users track their Instagram Growth & Trends. Socialdive is an independent service and is not affiliated with, endorsed by, or connected to Instagram or Meta Platforms, Inc.
Eligibility
You must be at least 13 years of age to use Socialdive. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and complete. If you are using Socialdive on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
Acceptable Use
You agree to use Socialdive only for lawful purposes and in a manner consistent with all applicable laws and regulations. You must not use the platform to harass, stalk, intimidate, or harm any individual; collect data on minors without appropriate consent; attempt to gain unauthorised access to other users' accounts or our systems; reverse-engineer, scrape, or copy any part of the platform; use automated tools or bots to interact with the service in excess of normal usage; or resell, redistribute, or commercialise the data obtained through Socialdive without our prior written consent.
Account Security
You are responsible for keeping your login credentials secure and for all activity that takes place under your account. You must notify us immediately at hello@socialdive.ai if you become aware of any unauthorised access or suspected security breach. We will not be liable for any loss arising from your failure to protect your credentials.
Subscriptions and Billing
Socialdive offers Weekly, Quarterly, and Lifetime access plans. Subscription fees are charged in advance via Stripe. Weekly and Quarterly plans renew automatically at the end of each billing cycle unless cancelled. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current paid period — you retain access until that date. Refunds are governed by our Refund Policy.
Intellectual Property
All software, design, content, trademarks, and branding associated with Socialdive are the exclusive property of KFY Digital, Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform for personal use in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from any part of the platform without our express written permission.
Disclaimer of Warranties
Socialdive is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We make no warranty that the service will be error-free, secure, or that any specific results will be obtained from its use.
Limitation of Liability
To the fullest extent permitted by applicable law, KFY Digital, Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of Socialdive, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to us in the 30 days preceding the event giving rise to the claim.
Termination
We reserve the right to suspend or terminate your account at our discretion if you breach these Terms, engage in abusive behaviour, or use the platform in a way that poses a risk to other users or the integrity of the service. Where possible, we will provide notice before taking such action. Upon termination, your right to access Socialdive ceases immediately.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will revise the date at the top of this page. For material changes, we will notify you via email or a notice on the platform. Continued use of Socialdive after updated terms are posted constitutes your acceptance of the revised Terms.
